Welcome to The Designer Edit Marketplace (“we”, “us”, “our”, or “The Designer Edit”). These Terms of Service (“Terms”) govern your use of our peer-to-peer platform (“Marketplace”) located at [Insert URL], where users can list and purchase pre-owned designer items.

By accessing or using the Marketplace, you agree to comply with and be legally bound by these Terms. If you do not agree, please refrain from using the Marketplace.

  1. Marketplace Nature & Role

The Designer Edit Marketplace is a peer-to-peer selling platform, not a retailer or consignment store. We do not own, sell, or market any of the items listed on our platform. We do not act as an agent, buyer, seller, or consignor of any product.

We simply provide the space for users to connect, list items, and transact with one another. Any sale made through the platform is strictly between the buyer and the seller.

  1. Brand Disclaimer

The Designer Edit is not affiliated with, endorsed by, or officially associated with any of the designer brands listed or mentioned on the Marketplace.

All trademarks, brand names, and logos are the sole property of their respective brand owners. They are used on our platform strictly for identification and informational purposes.

  1. Authentication

All items listed on the Marketplace are uploaded directly by individual sellers.

The Designer Edit does not guarantee the authenticity of any item unless it has been explicitly authenticated through our in-house or partnered authentication service. Authenticated items will be clearly marked as such with a visible badge in the listing images and a note in the product description.

Buyers are encouraged to seek authentication for peace of mind. If an item has not yet been authenticated, buyers may request authentication through The Designer Edit at their own expense prior to purchasing.

We only vouch for items that have been authenticated through our official process.

  1. Liability & Responsibility

The Designer Edit is not liable for:

The accuracy or legality of any listing The condition, delivery, or authenticity of any item Transaction outcomes or disputes between users Misrepresentations, fraud, or losses We are not involved in the transaction and do not handle payments, shipping, returns, or customer service between buyers and sellers.

You use the platform at your own risk and are solely responsible for any interaction or transaction made.

  1. Returns & Disputes

Returns, refunds, or exchanges are entirely at the seller’s discretion. The Designer Edit does not facilitate or mediate return requests.

We encourage clear communication between buyers and sellers prior to purchase. All users are responsible for reading item descriptions, reviewing photos, and asking questions before completing a transaction.

  1. Listing Guidelines

Sellers must:

Only list items they legally own Accurately describe brand, condition, and authenticity Avoid misleading titles, photos, or tags Not list counterfeit or replica items By listing an item on The Designer Edit Marketplace, sellers are formally acknowledging that the item is authentic. Listing counterfeit or knowingly misrepresented goods is a breach of these Terms and will not be tolerated.

If it comes to our attention that an item is not authentic:

The listing will be removed immediately The seller’s account will be suspended or permanently banned Further legal action may be taken depending on the severity of the breach The Designer Edit reserves the right to remove any listing that violates these rules or raises concerns about authenticity, legality, or safety. If we suspect an item may be counterfeit, we may:

Temporarily unpublish or remove the listing Request proof of authenticity (e.g., receipts, certificates, close-up photos) Refuse or ban further listings from the user if concerns remain unresolved 7. No Marketing or Endorsement

The Designer Edit does not promote or market any individual item listed for sale.

From time to time, we may feature product photos in editorial content, trend reports, or social campaigns. However, we will never disclose the identity of the seller or owner of that item.

Our content is strictly informational and does not constitute an endorsement or validation of any listing.

  1. Account Suspension & Termination

We reserve the right to:

Suspend or terminate any user account Remove listings Block access to the platform …if we believe there has been a breach of these Terms, suspected fraud, counterfeit activity, or behavior that puts users or the platform at risk.

  1. Platform Changes

The Designer Edit may update or modify the Marketplace at any time, including its layout, features, and services.

These Terms may also be updated periodically. Continued use of the platform after changes indicates your acceptance of the revised Terms.

  1. Limitation of Liability

To the fullest extent permitted by law:

The Designer Edit is not responsible for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to issues related to authenticity, delivery, product quality, or user conduct. We do not offer refunds, reimbursements, or compensation of any kind. All activity on the platform is conducted at your own risk, and all transactions are strictly between buyers and sellers. 11. Indemnification

You agree to indemnify and hold harmless The Designer Edit, its owners, affiliates, and partners from any claim, loss, or liability arising out of your:

Violation of these Terms Improper use of the platform Breach of any third-party rights (including trademarks or intellectual property) Sale or purchase of counterfeit goods 12. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any dispute arising out of or relating to your use of the Marketplace will be subject to the exclusive jurisdiction of the courts of NSW.
